Terms of service
Effective [date of publication]
These terms are an agreement between [company legal name] (“we”, “us”) and the business that creates a workspace, or the creator who joins our marketplace (“you”). By signing up you accept them. If you sign up for a business, you confirm you may bind it. The data processing agreement is part of these terms; the privacy policy explains how we handle personal data.
Buyerhint is for businesses and professionals. It isn't offered to consumers, and you must be at least 18 to use it.
1. The service
Buyerhint has four parts: outreach (finding people who engaged with you or your market and drafting messages to them), a creator marketplace for launches, free tools, and AI launch videos. New workspaces get a 7-day free trial without a card; when it ends, paid features stop until you choose a plan. We improve the service all the time and may change or remove features; if we remove something central to your plan, you may cancel and we will refund the unused part of the period you paid for.
2. Your account
Keep your sign-in secure and tell us at once if you think someone else has access. You are responsible for what happens in your workspace, including what your team members do.
3. Plans, payment and refunds
- Creem is our merchant of record. When you buy a plan or a package, Creem sells it to you, charges you, adds sales tax or VAT where it applies and issues the invoice; Creem's buyer terms apply to the payment itself.
- Plans are billed monthly in advance, in US dollars. Each plan's limits are exact monthly units listed on the pricing page. They reset on the 1st of each month (UTC) and don't roll over. When you reach a limit, that feature waits for the next month or an upgrade; nothing is charged automatically.
- You can cancel at any time from billing settings. You keep the plan until the end of the period you paid for.
- Subscription fees aren't refunded for partly used periods. We refund a charge made in error, and anything the law requires us to refund.
- We give at least 30 days' notice before changing the price of a plan you're on.
4. Using data and sending messages lawfully
For prospect data in your workspace you are the controller and we are your processor. You decide whom to contact, and you are responsible for your outreach. You agree to:
- Use Buyerhint only to reach people in their professional capacity, about something relevant to their work.
- Use only public data or data you have the right to use, and never data from hidden or restricted profiles.
- Not add sensitive data (such as health, religion, politics or sexual orientation) or data about anyone under 18.
- Follow the laws that apply to your messages, such as the GDPR, the UK GDPR and PECR, the EU ePrivacy rules, CAN-SPAM in the United States and CASL in Canada. Some countries, for example Germany, require prior consent even for business email; don't email people there without it.
- Identify yourself and your business in every message, include your business postal address in emails, never use a misleading subject line, and honor every unsubscribe and opt-out immediately. Opted-out people are removed from your workspace and can't be added back.
- Send messages on LinkedIn and X yourself, by hand. Don't use the product, or tools around it, to automate them.
- Not use data found on GitHub to send unsolicited email, which GitHub's rules forbid.
- Add the website visitor script only to sites you control, and ask visitors for consent first where your local law requires it.
- Not use Buyerhint or its data to decide anyone's eligibility for employment, credit, insurance or housing, and not sell or give prospect data to anyone else.
5. Acceptable use
Don't use Buyerhint to:
- send spam, harass anyone, or promote anything illegal, deceptive or harmful;
- get around plan limits, opt-outs, rate limits or security measures;
- scrape, copy or resell the service, or reverse engineer it except where the law allows;
- break the rules of the platforms you connect, such as X, Reddit, GitHub, YouTube, Google or Microsoft;
- arrange coordinated engagement, fake reviews or bought followers.
We may limit or disable a data source when a platform changes its rules or asks us to. We may suspend a workspace that breaks this section, after notice unless the risk to others or the law requires us to act at once.
6. Your content and data
You own what you put into Buyerhint. You let us host, process and transmit it only to run the service for you, as the data processing agreement describes. We may use aggregated figures that identify no customer, creator or person, such as price ranges built from completed creator orders across several workspaces, to run and improve the service. You can export your data at any time through the API or ask us for a copy, and you can ask us to delete your workspace; we delete it within 30 days.
7. AI features
Drafts, rewrites, scores and shortlists are made with AI and can be wrong or incomplete. Review them before you send or publish anything; you are responsible for what you send. We don't use your content to train AI models. Scores from the free tools are rules of thumb, not predictions of reach.
8. Creator marketplace, for brands
- Creators are independent. An order is an agreement between you and the creator on the terms shown in the order; we run the marketplace and aren't a party to it.
- Our platform fee is 10% on top of the creator's price and includes payment processing. Payments are held and paid out by a licensed payment provider, not by us. The amount is released to the creator once the post is live and its sponsorship label is checked; if the creator declines, the offer expires or the order is cancelled before posting, the full amount, fee included, goes back to you.
- If you and a creator disagree about an order, either of you can open a dispute. We review what both of you send and decide whether the payment is released or returned.
- Don't ask a creator to hide that a post is paid, to make claims they can't support, or to engage with other creators' posts. A launch window is a time slot, not coordinated engagement.
- You may use a creator's post only within the usage rights stated in the order.
9. Creator marketplace, for creators
- Connect only accounts, channels and newsletters you own. Statistics you report must be real and match your analytics: no bought followers, subscribers, engagement or fake accounts. We may remove a profile whose audience fails our authenticity checks.
- Every sponsored post must carry the platform's paid partnership label where it exists and clearly say it is paid, for example with #ad, as the FTC, the UK's CMA and ASA, and EU consumer law require. Newsletter placements say "Sponsored by" or similar next to the brand; YouTube videos turn on YouTube's paid promotion setting. Instagram and TikTok posts turn on the platform's paid partnership label and also say #ad in the caption; you agree that we read the delivered post on your connected account to check this. We hold the payment until this is checked.
- You keep ownership of your posts and give the brand only the usage rights stated in the order. Keep a post live for the keep-up period the order states.
- You work as an independent contractor, not our employee or agent. You are responsible for your own taxes; our payment provider may ask for tax forms before paying you.
10. AI launch videos
- An AI launch video is made by software, not by a person. We open the web address you give us, take screenshots of its public pages and read its text. AI services then write a script and generate short clips (for the intro, transitions and background shots, never your product's screens), a voiceover and music, and we assemble the video. You can preview it, change the on-screen text and voiceover, regenerate AI clips, and render it again, up to the numbers listed for the product.
- You confirm that you own or have permission to use the website you give us and anything you upload (screenshots, recordings, logos, names, trademarks), and that using them in a video doesn't infringe anyone's rights or break any law. You are responsible for what your video claims; check it before you publish.
- AI output can be imperfect. Scripts, clips, voices and music may contain mistakes, odd visuals, mispronunciations or statements that aren't accurate. Review and edit the preview before you render and before you publish. We don't promise any result, such as views, sign-ups or sales.
- Once you have paid, you may use the finished videos anywhere, including in ads. As between you and us, you own them, to the extent the law allows ownership of AI-generated material. The AI providers we use allow commercial use of their output; we don't guarantee that similar output isn't generated for others. Your materials stay yours; you let us use them only to make and deliver your video.
- This is a one-time, self-serve purchase. You get a full refund if generation hasn't started. After that, we refund in full if we can't deliver a renderable video (for example, your site can't be captured and you have no files, or generation keeps failing) and you tell us within 14 days. We don't refund a creative choice you could have edited or regenerated. Rights that the law doesn't let us exclude still apply.
- We may refuse or stop a video that infringes someone's rights, shows illegal or harmful content, or impersonates a person or company. Finished files are stored at an unguessable link that anyone holding it can open; keep your own copy.
11. Free tools
The free tools work without an account and are provided as they are, without any promise about their results.
12. Our rights
We own Buyerhint, its software and its design. These terms give you the right to use it while your account is open, nothing more. If you send us feedback, we may use it without owing you anything.
13. Confidentiality
Each of us will keep the other's non-public information confidential and use it only for this agreement, unless it becomes public through no fault of the receiver or the law requires its disclosure.
14. Other services
Buyerhint connects to services we don't control, such as X, Reddit, GitHub, Bluesky, YouTube, Instagram, TikTok, Google, Microsoft, HubSpot, Slack and Creem. Their terms apply to your use of them, and we aren't responsible for them or for changes they make. Buyerhint uses YouTube API Services: by using its YouTube features you agree to the YouTube Terms of Service.
15. Ending the agreement
You can stop at any time by cancelling your plan and deleting your workspace. We may end the agreement with 30 days' notice, or at once if you seriously or repeatedly break these terms. When it ends, you can export your data for 30 days; after that we delete it. Sections 6, 12, 13 and 16 to 19 survive.
16. Warranties
We provide Buyerhint with reasonable skill and care. Beyond that, and as far as the law allows, it is provided “as is”: we don't promise any particular result, such as replies, sales, deliverability, or that a found email address or a score is accurate.
17. Liability
As far as the law allows, neither of us is liable for indirect or consequential loss, or for lost profits, revenue, data or goodwill, and our total liability under these terms is limited to the amount you paid us in the 12 months before the claim. Nothing in these terms limits liability for fraud, for death or personal injury caused by negligence, or for anything else the law doesn't allow to be limited.
18. Indemnity
You will defend us against, and pay the costs of, claims by third parties that arise from your messages, the data you add, the content you publish or your breach of these terms or of the law.
19. Governing law and disputes
These terms are governed by [governing law, e.g. the laws of the State of Delaware, USA]. The courts of [courts, e.g. the state and federal courts in Wilmington, Delaware] have exclusive jurisdiction, but either of us may seek urgent relief anywhere.
20. General
- We may update these terms. We will give 30 days' notice by email of changes that matter; continuing to use Buyerhint after that means you accept them.
- You may not transfer this agreement without our consent; we may transfer it to a company that takes over the service.
- Neither of us is responsible for delays caused by events beyond reasonable control.
- You confirm that you aren't on a sanctions list and won't use Buyerhint from, or for anyone in, a country under comprehensive sanctions.
- If a part of these terms is invalid, the rest stays in force. Not enforcing a term isn't a waiver of it.
- These terms, the data processing agreement and any order form are the whole agreement between us about Buyerhint.
